We make sheets we’re genuinely proud of. If something’s wrong with your order, we’ll fix it. Our 30-day change-of-mind return policy is straightforward, and your rights under Australian Consumer Law always apply. The full terms below cover the details - but that’s the spirit of it.

Section 1 — Overview

(a) This website (Site) is operated by Senn Linen Pty Ltd (ABN 18 681 388 527) trading as The Good Sheet (we, us, our). You or your refers to anyone accessing or using the Site.

(b) By using this Site and/or purchasing products (Products), you agree to be bound by these Terms, together with our Privacy Policy, Shipping and Returns policy, and any other terms on this Site.

(c) If you do not agree to these Terms, please do not use this Site.

(d) We may update these Terms at any time by updating this page. Continued use of the Site after an update constitutes acceptance of the revised Terms. We reserve the right to suspend or remove your access to this Site at any time, including where we reasonably suspect misuse, fraud, or a breach of these Terms.

Section 2 — Placing an Order

SUBMITTING AN ORDER

(a) By submitting an order, you confirm that you have legal capacity and are of sufficient age to enter into a binding contract and are authorized to use the payment method you provide.

(b) An order is not confirmed until you receive a written confirmation from us that your order is being processed. Title in the products remains with us until payment is received in full.

(c) We reserve the right to refuse or cancel any order. If payment has already been taken, we will refund it in full to your original payment method.

PRICING

(a) Prices are displayed and charged in Australian Dollars (AUD) for Australian customers. New Zealand customers will see prices in New Zealand Dollars (NZD) at the current exchange rate. Exchange rates are managed by Shopify and may vary. All prices are per unit unless otherwise stated.

(b) Prices may change without notice prior to you completing an order.

(c) All prices include GST where applicable.

(d) If we discover a pricing error after you have placed an order, we will contact you as soon as possible. You may choose to proceed at the correct price or cancel for a full refund to your original payment method.

PAYMENT

(a) Payment is required at the time of placing an order.

(b) We accept payment via Shopify Payments, Afterpay, Zip Pay, and PayPal. Payments are processed by third-party providers whose terms also apply: Shopify Payments, Afterpay, Zip Pay, PayPal. To the maximum extent permitted by law, we are not liable for the security or performance of any payment provider. We reserve the right to correct, or to instruct our payment provider to correct, any errors or mistakes in collecting your payment.

(c) We reserve the right to charge credit card surcharges where applicable. Any surcharge will be disclosed at checkout prior to you completing your order.

PRODUCTS

(a) We make every effort to display our products accurately on this Site. Due to variations in screen resolution, brightness and color settings, the color and appearance of products may differ slightly from what you see on your screen. If you’d like a better sense of color before ordering, we recommend requesting a swatch.

(b) Some products are available in limited quantities. We reserve the right to limit the quantities of any product we offer and to discontinue any product at any time without notice.

(c) We reserve the right to restrict or cancel sales to any person, region, or jurisdiction at our discretion, including where orders appear to be placed by resellers or distributors rather than end consumers.

(d) Product descriptions and pricing are subject to change at any time without prior notice.

(e) We take care to describe and photograph our products accurately, and we encourage you to read product descriptions carefully before purchasing. We cannot guarantee that a product will meet your individual expectations — personal preference varies, and what suits one person may not suit another. This does not affect your rights under the Australian Consumer Law.

(f) We make no representation that our products are suitable for any particular purpose, medical condition, allergy, or individual need. If you have specific concerns, please contact us before ordering.

(g) Products must be used in accordance with any care and usage instructions provided. To the maximum extent permitted by law, we are not responsible for any loss or damage arising from misuse of our products.

GIFT CARDS

(a) Gift cards can be redeemed against any product on this Site and do not expire.

(b) Gift cards cannot be exchanged or redeemed for cash, and are not reloadable.

(c) Lost or stolen gift cards cannot be replaced or refunded.

(d) Returns of products purchased using a gift card will be subject to our Returns Policy.

(e) We reserve the right to cancel a gift card where we reasonably suspect fraud or misuse. If we do so without cause, we will refund the remaining balance.

(f) Gift card terms may be updated from time to time. Continued use of a gift card after any update constitutes acceptance of the revised terms.

ACCOUNTS

(a) You are not required to, but may choose to, create an account to purchase. You are responsible for keeping your account details accurate and your password secure.

(b) As part of the account registration process and as part of your continued use of the Site, you may be required to provide personal information such as your email address, name, preferred username, a secure password, billing and postal addresses, mobile phone number, and other information as determined by us from time to time.

(c) You warrant that any information you give to us in the course of completing the account registration process will always be accurate, honest, correct and up to date.

(d) We may suspend or cancel your account if you do not comply with these Terms or for any other reason on notice to you.

Section 3 — Delivery

(a) Delivery costs, if applicable, will be calculated and displayed at checkout. We reserve the right to charge for delivery at any time, including where delivery has previously been provided free of charge.

(b) Orders will be delivered to the address entered at checkout. It is your responsibility to ensure this address is correct before completing your purchase. We are not liable for orders delivered to an incorrect address as a result of information provided by you.

(c) You acknowledge that delivery is carried out by a third-party courier and all delivery timeframes are estimates only and subject to delays beyond our control. We do not guarantee delivery within any specified time and will not be liable for any loss or damage suffered as a result of late delivery.

(d) Risk in the products passes to you on delivery. Delivery must not be refused. Where a parcel is returned to us as unclaimed or refused, we reserve the right to recover our reasonable costs of re-delivery or return from you.

(e) Any issues with delivery, including lost or damaged orders, should be directed to us in the first instance. We will resolve the issue directly with you and manage any claim with the carrier on your behalf.

(f) International orders may be subject to customs and import duties, which are your responsibility. We are not liable for any delays or costs incurred in having an order released from customs, including reimbursing you for any customs or import duties you may pay. If an international order is refused or returned unclaimed, we reserve the right to recover our reasonable costs from you.

Section 4 — Returns and Cancellations

CANCELLATION BY US

We reserve the right to cancel any order. Where payment has been taken, a full refund to the original payment method will be issued.

CANCELLATION BY YOU

You may cancel your order at any time before we send you a written order confirmation. Once confirmed, your order is binding.

CHANGE OF MIND RETURNS

(a) If you’re not satisfied with your purchase, we accept returns for change of mind within 30 days of receipt, provided the product is:

i. full-priced (sale and clearance items are not eligible);

ii. returned in original, unopened and unwashed condition; and

iii. in its original packaging.

(b) Return shipping for change of mind returns is at your expense. Gift vouchers are not refundable.

(c) Further details regarding how to initiate a return, return processing timeframes, shipping rates, international order handling (including customs duties and cost recovery for refused or unclaimed international parcels), and other operational matters are set out on our Shipping and Returns page (Returns Policy), which forms part of these Terms. In the event of any inconsistency between this clause and the Returns Policy in relation to your legal rights, this clause prevails.

FAULTY, DAMAGED OR INCORRECT PRODUCTS

(a) If you receive a product that is faulty, damaged, or not what you ordered, please contact us using the details on our website.

(b) Nothing in these Terms limits your rights under the Australian Consumer Law, which are not subject to a fixed time limit. Claims relating to faulty products will be assessed on their merits regardless of when they are made.

(c) Discoloration from normal wear, washing, or failure to follow care instructions is not considered a manufacturing fault. Please refer to our Care Guide for instructions on caring for your products.

(d) If we determine a product is faulty, we will provide a refund, replacement, or store credit, including reimbursement of reasonable return postage on receipt of proof.

EXCHANGES

To exchange, place a new order for the item you want and return the original in accordance with the relevant clause above. Full details on our Shipping and Returns page, which forms part of these Terms. Products sold as part of a set cannot be exchanged or returned individually.

We use third-party services in connection with operating this Site and fulfilling orders, including but not limited to the following. Additional third-party providers may be used from time to time and may not be listed here.

THIRD PARTY PLATFORM 

(a) This Website is powered by a third party platform (Shopify) and the terms and conditions of that third party may apply to your use of this Site to the extent applicable to you. Those terms can be accessed here: https://www.shopify.com/id/legal/terms.

(b) To the maximum extent permitted under applicable law and our agreement with our third party platform provider, we will not be liable for any acts or omissions of that third party, including in relation to any fault or error of the Website or any issues experienced in placing Orders.

Section 6 — Intellectual Property

(a) In this clause, “intellectual property rights” means all copyright, trade mark, design, patent, trade, business, company and domain names, confidential and other proprietary rights, and any other rights to registration of such rights whether created before or after the date of these Terms both in Australia and throughout the world.

(b) All content on this Site, including all information, design, text, graphics, logos, images, icons, video, product designs, advertisements and trademarks (registered or otherwise) is owned by or licensed to us. You may not reproduce, copy, or commercialise any of it without our prior written consent.

(c) The Company retains all intellectual property rights in the design of the Products, including labelling and packaging. You must not attempt to copy, reproduce, manufacture or otherwise commercialise the Products or any aspect of their design.

(d) You may make a temporary electronic copy for the sole purpose of viewing the Site.

(e) You may not use the Site for any purpose other than browsing, selecting or purchasing Products.

Section 7 — Your Obligations

By using this Site, you agree that you will not:

(a) use this Site or purchase our products for any unlawful or unauthorized purpose;

(b) use this Site in any way that could damage our reputation or the goodwill associated with The Good Sheet brand;

(c) submit false, misleading, or fraudulent information, including at checkout or in any communication with us;

(d) copy, mirror, reproduce, translate, adapt, vary, modify, sell, decipher or decompile any part or aspect of the Site without our prior written consent;

(e) act in a way that may diminish or adversely impact our reputation, including by linking to the Site on any other website in a manner we have not approved;

(f) use this Site to infringe the intellectual property or other rights of any third party;

(g) use automated tools, bots, or scraping software to access, monitor, or copy any content from this Site without our prior written consent; or

(h) attempt to undermine or breach the security of the Site or otherwise interfere with its normal functions, including by:

i. gaining unauthorized access to Site accounts or data;

ii. scanning, probing or testing the Site for security vulnerabilities;

iii. overloading, flooding, mailbombing, crashing or submitting a virus to the Site; or

iv. instigating or participating in a denial-of-service attack against the Site.

Section 8 — Warranties and Liability

AUSTRALIAN CONSUMER LAW

If you are an Australian customer, you may have rights under the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth), including entitlements to a refund, replacement or repair if there is a failure with goods or services provided. Nothing in these Terms is intended to limit those rights.

Please note that:

(a) products sold by us will have only the benefit of any warranty given, and insurance held, by the manufacturer; and

(b) to the maximum extent permitted by applicable law, all express or implied representations and warranties not expressly stated in these Terms are excluded.

US Consumer Rights

If you are a customer in the United States, you may have rights under applicable federal and state consumer protection laws. Nothing in these Terms is intended to exclude or limit any rights you have under those laws that cannot be excluded by contract.

Both markets

To the maximum extent permitted by applicable law, all express or implied representations and warranties not expressly stated in these Terms are excluded. Products sold by us will have only the benefit of any warranty expressly provided by us.

LIMITATION OF LIABILITY

(a) To the maximum extent permitted by law, our total liability to you in connection with these Terms is limited to the amount paid by you under the most recent order.

(b) To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss or damages, including loss of data, revenue, profit, goodwill, anticipated savings or business opportunity, except: (i) in relation to liability for fraud, personal injury, death or loss or damage to tangible property; or (ii) to the extent this liability cannot be excluded under the Competition and Consumer Act 2010 (Cth).

WEBSITE AVAILABILITY AND INFORMATION

We do not warrant that this Site will be error-free, uninterrupted, or free from viruses or other harmful components. You use the Site at your own risk. While we make every effort to ensure that information on the Site is accurate and up to date, the Site may at times contain errors or defects, be inaccessible, messages sent through the Site may not be delivered promptly or delivered at all, or the Site may display information that is not current. We reserve the right to change any information or functionality on the Site at any time without notice.

SECURITY

To the maximum extent permitted by law, we do not accept responsibility for loss or damage to computer systems, mobile phones or other electronic devices arising in connection with use of the Site. You should take your own precautions to ensure that your process for accessing the Site does not expose you to risk of viruses or malicious code.

LINKS TO OTHER WEBSITES

The Site may contain links to other websites that are not our responsibility. We have no control over the content of any linked websites and are not responsible for that content. Inclusion of any linked website does not imply our approval or endorsement.

REPORTING MISUSE

If you become aware of misuse of the Site by any person, any errors in material on the Site, or any difficulty in accessing or using the Site, please contact us using the details on our website.

Section 9 — Force Majeure

(a) We are not liable for any delay or failure to fulfill an order arising from circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, acts of war or terrorism, pandemic or widespread health emergency, supply or shipping disruptions, industrial action, internet or power outages, or changes in applicable law (each a Force Majeure Event).

(b) If a Force Majeure Event prevents us from fulfilling your order, we will notify you as soon as reasonably practicable. You may cancel your order and receive a full refund if the delay is likely to be significant.

Section 10 — Indemnification

You agree to indemnify and hold harmless The Good Sheet, its directors, employees and representatives from any claim, loss, damage or expense (including reasonable legal costs) arising directly or indirectly from:

(a) your breach of these Terms;

(b) any inaccuracy in information or data you provide to us; or

(c) your infringement of any third party’s rights, including intellectual property rights.

Section 11 — General

GOVERNING LAW

If you are purchasing from Australia or New Zealand, these Terms are governed by the laws of Tasmania, Australia. Each party submits to the exclusive jurisdiction of the courts of Tasmania and courts of appeal from them, and waives any objection to venue on the basis of inconvenient forum.

If you are purchasing from the United States, these Terms are governed by the laws of the State of Texas, and any disputes will be resolved in the courts of that state.

This Site may be accessed from multiple countries. We make no representation that this Site or its content complies with the laws of any country other than Australia and the United States. If you access this Site from any other location, you do so at your own risk and are responsible for ensuring your use of this Site complies with the laws applicable in your location.

WAIVER

No party to these Terms may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.

CHANGES TO THESE TERMS

We may update these Terms at any time. Changes take effect when posted to this page. Continued use of the Site after any change constitutes acceptance.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remainder will continue in full force.

ASSIGNMENT

A party cannot assign, novate or otherwise transfer any of its rights or obligations under these Terms without the prior written consent of the other party.

NOTICES

(a) Any notices required to be sent under these Terms must be sent via email. Notices to us should be sent to hello@thegoodsheet.com.au.

(b) A notice will be considered delivered 24 hours after it was sent, unless the sender has reason to believe the email failed to send or was not delivered or received.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Shipping and Returns policy, constitute the entire agreement between you and us regarding your use of this Site and purchase of products.
